What is a Sunbed Licence?

UK business owners do not require a licence to operate a tanning salon but will need to abide by strict guidelines as set out in the Sunbeds (Regulations) Act 2010.

The act, which came into force on 8 April 2011, states that businesses providing the use of sunbeds to the public must ensure that no person under the age of 18 years of age must be allowed to use a sunbed within the premises.

The strict age restriction guideline is because young people are at higher risk of developing skin cancer from over-exposure to UV rays. As a result, age restrictions and safeguarding protocols must be implemented within a tanning salon business.

These safeguarding protocols include staff being trained on UK age restriction legislation and being actively encouraged to ask customers who they believe to be under the age of 21 for a form of photo ID under the ‘Challenge 21 age verification scheme’.

 

Important: Local authority may conduct premises inspections to ensure that registered staff have completed and are up to date with training, and that age safeguarding protocols have been implemented.

 

 

What is the Sunbed Association?

The Sunbed Association is the official association for tanning salons within the UK and was established with the intent to promote good practice within the industry. While membership of the Sunbed Association is not a mandatory requirement, it is recommended that new tanning salon businesses sign up.


Being members of the Sunbed Association publicly showcases a business that promotes the safe practice and responsible tanning within its premises.

Companies will also receive marketing material and Health and Safety posters, as well as training material for staff.
 

Applications for membership can be made via the Official Sunbed Association Website.

 

Important: Becoming a member of the Sunbed Association is not a legal requirement but will positively promote your business as a reputable outlet where customers will be reassured that you adhere to Sunbed Association codes of practice.

No. Sunbeds are legal in the UK, but under the Sunbeds (Regulations) Act 2010, it is an illegal offensive for people under the age of 18 to use sunbeds.

Yes. All staff that works in tanning salons must be trained appropriately on UK age restriction legislation, including ‘Challenge 21 polices’ while ensuring that nobody under the age of 18 years is authorized to use a sunbed within the premises.

Challenge 21 is an age verification scheme within the UK that encourages all customer-facing staff to ask for a form of ID when serving someone they believe to be below the age of 21. Staff who work within a tanning salon must be encouraged to ask for a photo ID such as a passport from customers who they believe to be under the age of 18 years.

If it is found that a person under the age of 18 years has used a sunbed within a tanning salon, this could lead to enforcement action and sanctions taking place to the business. The business owner may also face having to pay a fine and even imprisonment.
